The Royal Advisor in Morocco -Royal Trust and National Expertise in the Service of the State: A Study in Public Law and Political Sociology of Advisory Influence and the Limits of Legal Competence

Abstract

This study examines the legal status and sociological position of the royal adviser in Morocco, tracing the genealogy of counsel within the Moroccan system of government, its gradual institutionalization within the Royal Cabinet, and its position under the 2011 Constitution. It tests the hypothesis that the adviser’s institutional strength does not constitute a parallel constitutional competence, but rather a form of influence derived from royal trust, national expertise, and the capacity to produce knowledge for decision-making.

Combining historical inquiry, comparative public law, and the political sociology of executive entourages, the study distinguishes between legal status, legal competence, royal assignment, political influence, and institutional control. It also examines the diverse professional trajectories of the advisers serving under King Mohammed VI and considers the career of Fouad Ali El Himma as a case study through which to test the distinction between accumulated institutional experience and allegations of legally unsupported authority.

The study concludes that the metaphor of a “shadow government” is analytically inadequate. The verified evidence does not establish the existence of a parallel executive body endowed with autonomous powers. It reveals, instead, a strong royal advisory entourage whose effectiveness rests on institutional loyalty, royal trust, accumulated expertise, and a sustained commitment to the service of the Moroccan State.
